How Can You Help a Family Member Immigrate to the U.S.?
Not every immigrant visa holder is eligible to take advantage of a family-based visa. Eligibility depends on a number of factors including:
- Your individual immigration status
- Your familial relationship with the individual(s) you want to immigrate to the U.S.
- Your income
To be eligible to help a family member immigrate, you must be either a:
- U.S. citizen
- Permanent resident (Green Card holder)
- Refugee admitted as a refugee within the past 2 years or granted asylum within the past 2 years
Types of Family-Based Visas
There are two types of family-based visas, and eligible individuals who are at least 21 years of age can sponsor a family member to immigrate to the U.S. The two types of family-based immigrant visas are:
- Immediate Relative Visa – these visas are based on a close family relationship with a U.S. citizen. U.S. citizens may sponsor their spouses, children, or parents.
- Family Preference Visa – these visas are for specific, more distant, family relations of a U.S. citizen and specific relations of a Lawful Permanent Resident (LPR).
While U.S. citizens can sponsor a spouse, child, parent, or sibling, U.S. LPRs can only petition for their spouse or unmarried children.
Eligible asylees or refugees may sponsor a spouse or unmarried child who was under the age of 21 when the sponsor applied for asylum or refugee status.
