Investor Visa Options
There are two visa opportunities that investors can take advantage of – the EB-5 Immigrant Investor Program and the E-2 Treaty Investor.
Who Can Benefit from the EB-5 Program?
The EB-5 program allows qualified investors to apply for lawful permanent residence. To qualify, the investor must:
- Invest in a commercial enterprise in the United States
- Create or preserve 10 permanent full-time jobs for qualified U.S. workers
Under the EB-5 program, investors can apply along with their spouses and unmarried children under the age of 21.
Who Can Benefit from the E-2 Treaty Investor Visa?
The U.S. maintains treaties of commerce and navigation with certain countries. These treaties allow nationals of treaty countries to enter the U.S. for specified purposes. The E-2 is a non-immigrant investor visa that allows nationals of a treaty country to be admitted to the U.S. based on their substantial capital investment in a U.S. business. Certain employees of a qualifying individual or organization may be eligible for an E-2 visa.
Treaty investors and employees may be accompanied by their spouses and unmarried children under the age of 21.
Generally, the initial maximum period of stay for an E-2 Investor Visa is 2 years. The E-2 Investor Visa may be extended in increments of up to two years when visa holders file a request for an extension. Although there is no limit to the number of extensions an E-2 visa holder may be granted, all E-2 visa holders must maintain an intention to leave the U.S. when their visa expires or is terminated.
